This is an agreement to sublease a Stanley Quencher H2.0 Flowstate Tumbler between Edward McKelroy (hereinafter known as the “Sublessor”) and Matt Kennedy (hereinafter known as the "Sublessee.”)
The Sublessor agrees to sublet to the Sublessee, and the Sublessee agrees to take possession of the Stanley Quencher H2.0 Flowstate Tumbler under the following terms and conditions:
I. Term. Tenancy of this Sublease shall begin with the Sublessee taking possession on February 1, 2024, and end on February 1, 2025. Under no circumstances shall there be holdover, backwash, smells, or drink remnants left behind by the Sublessee.
II. Rent. The rent for this Stanley Quencher H2.0 Flowstate Tumbler shall be $480, payable on the first (1st) of every month. The rent total is subject to increases to coincide with market standards and the Stanley Tumbler’s popularity.
The rent shall be paid in the following manner: Venmo, Zelle, cash, check, or Target gift cards.
III. Utilities. The following utilities come with the Stanley Quencher H2.0 Flowstate Tumbler: heating and cooling. All other utilities shall be the responsibility and expense of the Sublessee, including water, seltzer water, juice, smoothie, soda, and other beverages.
IV. Liability. Sublessee agrees to surrender and deliver the Stanley Quencher H2.0 Flowstate Tumbler to the Sublessor in the same condition as it was at the beginning of the term with reasonable wear and signs of drinkage. The Sublessee will be liable to the Sublessor for any remaining stickers, stains, dents, or straw replacements. All actions and sips conducted by any guest drinkers of the Sublessee are the responsibility and liability of the Sublessee.
V. Guests. There shall be no other persons chugging out of the Stanley Quencher H2.0 Flowstate Tumbler other than the Sublessee. Guests of the Sublessee are allowed sips lasting no longer than sixty seconds unless otherwise approved by the Sublessor.
VI. Security Deposit. The Sublessor shall require a security deposit to be paid by the Sublessee in the amount of $480. The Sublessor shall also require three references of Liquid Lords from other tumblers the Sublessee has rented from.
Sublessor agrees that if the Stanley Quencher H2.0 Flowstate Tumbler and contents thereof are returned in the same condition as received by the Sublessee, excluding reasonable wear and tear, the deposit shall be refunded to the Sublessee within ten days after the end of the term.
Any reason for retaining a portion of the deposit shall be explained in writing to the Sublessee within ten days.
VII. Disputes. If a dispute arises during or after the term of this Sublease between the Sublessor and Sublessee, they shall agree to hold a public chug-off within 48 hours of the dispute arising.
VIII. Spit Takes. Spit takes or spitting of any general nature will not be permitted within ten feet of the Stanley Quencher H2.0 Flowstate Tumbler. Failure to comply will result in a $500 fee payable immediately to the Sublessor.
IX. Smoking. Smoking is prohibited within ten feet of the Stanley Quencher H2.0 Flowstate Tumbler.
X. Liquid Lord’s Consent. The original lease between the Liquid Lord and Sublessor does allow the right to sublet the Stanley Quencher H2.0 Flowstate Tumbler.
XI. Alternative Drinking Cups. The Sublessor will allow the Sublessee to drink from other drinking cups for a small monthly fee that will be included in rent. Fees will not exceed $200 for regular glasses and $300 for stemware.
XII. Date & Signature. The parties hereby bind themselves to this agreement by their authorization affixed below on January 24, 2024.
